On June 16, 2011, FERC denied appeals of NERC determinations to register two wind generators with significant generator leads as “Transmission Owners” (TO) and “Transmission Operators” (TOP), but in the process may have given these generators the regulatory certainty they were seeking. The decision creates significant doubt, however, for other generators regarding their status as TO/TOPs and their reliability compliance obligations. (more…)

New York Public Service Commission Seeks Comment Regarding Imposing Heightened Filing Requirements on Wholesale Generators and Electric and Gas Corporations
Wednesday, June 8, 2011 4:19 pm by Sandy Rizzo and Lindsey CorreaThe New York Public Service Commission (NYPSC) has issued a notice soliciting comment from interested entities on whether it should require wholesale generators and certain other electric and gas corporations to disclose additional information to it on an annual basis (Notice). In light of allegedly decreased filing requirements imposed on the federal level, the NYPSC believes it may no longer be able to rely upon the federally-reported information to satisfy the state’s requirements.
